(hereinafter referred to as 'Provider')

The following English translation is provided for information purposes only. Only the German version is legally binding.

1. Preamble

The Provider operates an offer for prepaid eSIM internet tariffs at the domain pingsim.com, primarily intended for tourists or business travelers. These GTC apply exclusively to distance selling via this domain. All other sales related to PingSIM, eSIM, or data tariffs that do not take place via this domain are subject to separate terms and conditions.

2. Definitions

Provider: TechTrade Solutions UG as the provider and operator of PingSIM, see above.

Customer: A person who places an order via the Provider's website.

Partner: Business partners from whom the Provider sources its products.

Mobile Network Provider: Partner network operators of telecommunications services.

3. Conclusion of Contract

Eligible to participate are natural persons aged 18 and over as well as legal entities.

The contract is only concluded by ticking the checkbox and thereby confirming that you have read, understood, and accepted the Terms and Conditions and the Privacy Policy.

This confirmation will be documented and stored by us.

The Terms and Conditions and the Privacy Policy can be viewed and downloaded before concluding the contract.

Consumers have a statutory right of withdrawal. Further information can be found in our withdrawal policy.

4. Subject Matter of the Contract and Services

The Provider acts as a reseller of eSIM data tariffs under the brand 'PingSIM' and sources its services from various partners based in Europe and the UK.

The offer includes exclusively one-time, non-recurring mobile data tariffs provided via activation codes for eSIM modules. Calls and SMS/MMS are not included.

The provided tariffs are offered by international mobile network providers and operators, over which the Provider has no influence.

The Provider's offer is limited to the distribution of the partners' tariffs and customer service. Our customer service includes exclusively: assistance with eSIM activation or installation issues, access problems, and questions about our offers. Not included: network coverage, device compatibility, or disruptions from third-party providers.

After purchase, the customer receives: an activation code for an eSIM (e.g., QR code/manual code), a one-time data tariff selected by the customer before ordering.

The Provider grants the customer a 30-day return period without giving reasons, provided the conditions in Section 5 are met.

The customer can, under certain circumstances and if the website allows, recharge an already installed and used eSIM with an additional data tariff. The Provider checks the compatibility of the eSIM and the desired data tariff before ordering.

The offered eSIM tariffs differ in terms of duration, data volume, speed, and location. Regional eSIM tariffs offer network coverage that may differ from individual country tariffs.

The respective mobile network providers of the regional tariffs can be found in the respective countries of the partners.

The billing of data volume for all eSIM tariffs is done in increments of 1 kilobyte (KB). The conversion units are defined as follows: 1 GB equals 1,000 MB, 1 MB equals 1,000,000 bytes, and 1 KB equals 1,000 bytes.

The data tariffs include a fixed duration in days and a fixed data volume in gigabytes (GB). The tariff ends automatically as soon as either the booked data volume is used up or the booked duration has expired, whichever occurs first. After expiration or consumption, no extension or reactivation is possible, and a new tariff must be booked. A refund or discount for unused portions after expiration or consumption is excluded.

The Unlimited tariff includes 1 GB of high-speed data per 24 hours. After consuming the 1 GB, the speed is throttled to approximately 1 Mbit/s. The 24-hour period begins with the first use and resets every 24 hours as long as the tariff is active. A refund for unused days is excluded, even if the customer does not fully use the tariff.

5. Return & Return Conditions

A data tariff and the associated provided eSIM can be returned to the Provider without giving reasons. This is only possible under the condition that: the eSIM has not been installed on a device, the order is not more than 30 days old at the time of return, the data tariff has not been used, the customer has not violated these GTC. The Provider reserves the right to check these conditions upon return. After successful verification, the customer will be refunded the full amount of the order via the original payment provider and method.

The refund will be processed by the Provider within a maximum of 3 business days and initiated with the payment provider upon success. The duration of the refund depends on the respective payment provider; the Provider has no influence on this. If the return conditions are not met, the customer will be informed of the reasons by email.

For the return, the customer must provide the Provider with the following: order number, email address, proof of ownership of the email. The proof is provided in the form of 2-factor authentication, which the Provider provides.

A refund or discount for unused portions after expiration or consumption is excluded. There is also no claim for refund or discount for countries not traveled within a regional tariff.

6.1 Rights, Duties, and Liability of the Provider

The Provider is only liable in cases of intent and gross negligence. In cases of simple negligence, liability exists only in the event of a breach of essential contractual obligations (cardinal obligations). The customer shall indemnify the Provider from all third-party claims arising from a breach of contract in the use of the eSIM and associated services.

The Provider does not guarantee uninterrupted connections, the availability of emergency numbers, or compatibility with security or customs functions.

No liability is assumed for speed losses due to local network congestion/regulations, damages due to device misconfiguration, or loss of the eSIM due to device reset/change without prior backup.

The service is provided without any warranty. The Provider assumes no liability for quality losses due to restricted/blocked services, speed reduction in case of network congestion, or incompatibility with certain network standards.

There is also no liability for roaming constellations such as auto-connect to inefficient partner networks or discrepancies between the displayed network name and the actual operator, as well as for external risks such as local SIM-lock rules or disruptions by third parties.

6.2 Rights, Duties, and Liability of the Customer

The customer is obligated to use the eSIM and all associated services exclusively within the framework of applicable laws. Illegal or abusive actions with the eSIM or the internet access enabled by it are prohibited.

The use of the eSIM is restricted to countries where the customer is not resident. Additionally, the customer is not permitted to engage in deceptions in promotions, credits, or referrals.

The customer may not upload or transmit content that violates the intellectual property rights of third parties. The eSIM is intended exclusively for private use; commercial use, such as through roaming hotspots, IoT devices, or server operation, is not permitted.

The customer must ensure that the eSIM is not used abusively. This includes avoiding unusually high data consumption and refraining from automated data queries. The customer is responsible for checking the compatibility of their device with the eSIM.

Transferring the eSIM to third parties, even temporarily, is prohibited. In case of loss or theft of the eSIM activation codes, immediate blocking is required. Additionally, network release is only permitted in explicitly allowed tariffs. In case of violations of these conditions, the Provider reserves the right to block access to the service and take legal action.

It is the responsibility of the customer to provide a correct and functional email address and to check the inbox (including the spam folder).

7. Duration and Termination

The contract ends automatically with the expiration of the booked service, whether through the passage of time or the consumption of the data volume. Manual termination occurs as soon as the eSIM is uninstalled from the device.

After the contract ends, the eSIM technically remains on the device but is without active service ('dummy eSIM'). In this state, there is no claim to network connection, number retention, or data transmission. The eSIM serves merely as a container for potential reactivations, which, however, always require a new contract conclusion.

The customer is obligated to uninstall the eSIM within 30 days after the contract ends. Failure to do so makes the customer liable for risks of misuse, such as unauthorized reactivation by third parties, as well as conflicts with new eSIM installations due to storage limitations.

Even if the eSIM technically continues to exist, this does not lead to automatic contract renewal, the creation of payment obligations, or the revival of previous service claims. Additionally, eSIMs should only be used in countries where the customer is not resident.

8. Prices, Taxes, Invoicing, Distinction Private/Company

Private customers do not receive an invoice. The prices are stated in euros, and the tax deductions and place of sale are in Germany, thus 19% VAT applies.

All prices displayed on the Provider's platform are inclusive of statutory taxes and fees (e.g., VAT, possibly country-specific fees), unless otherwise stated.

The amount of tax due depends on the billing address provided by the customer and is automatically calculated and displayed at the time of purchase.

Billing is done in the currency displayed on the Provider's website at the time of purchase. This may vary depending on the region or payment method used.

9. Data Protection

The Provider attempts to obtain, store, or pass on as little personal data of the customer as possible.

Further information can be found in the Provider's privacy policy on the domain.

10. Right of Withdrawal

Customers have a statutory right of withdrawal of 14 days from the date of purchase.

The withdrawal must be made in writing by email to widerruf@pingsim.de. The same conditions apply as for returns under Section 5 of these GTC.

11. Changes to the General Terms and Conditions

The Provider is entitled to change the General Terms and Conditions with effect for the future.

Changes will be communicated to customers at least 4 weeks before they come into effect via email or the website.

If the customer does not object to the changes within 14 days of notification, the amended terms will be considered accepted.

12. Final Provisions and Miscellaneous

The law of the Federal Republic of Germany shall apply exclusively. The place of performance and exclusive jurisdiction, insofar as legally permissible, is the Provider's registered office.

If individual provisions of these General Terms and Conditions (GTC) are or become invalid, the validity of the remaining provisions shall remain unaffected. The parties undertake to replace an invalid provision with a legally permissible, economically equivalent regulation. For all contractual and non-contractual claims, the law of the Federal Republic of Germany shall apply exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers within the meaning of § 13 BGB, the mandatory consumer protection law of their country of residence applies, if it is more favorable.

For merchants, legal entities under public law, or public special assets, the exclusive jurisdiction for all disputes is the Provider's registered office in Leipzig, Germany. This also applies to interim injunctions and arbitration proceedings. Consumers can file lawsuits either at their place of residence or at the Provider's registered office.

The contract language is German. The authoritative interpretation is exclusively the German language versions of these GTC and all associated documents.
